The fall of trade tariffs since the birth of the General Agreement on Tariffs and Trade (GATT) has led the attention of governments and entrepreneurs towards non-tariff measures (NTMs). Furthermore, a greater interdependency in a globalizing world, increased social awareness, and growing concerns regarding health, safety, and quality have contributed to the emergence of a vast and complex range of NTMs. The emergence of these measures raises new and pressing challenges for the international flow of commodities in the 21st century as they can also be applied in a manner that unnecessarily frustrates trade. According to the WTO, the food sector is the most affected by the spread of NTMs: it has been proven that the diversity of Food Safety Requirements imposed by some countries on agricultural imports contributes to trade restrictiveness. In this context, this research aimed to solve two specific questions: a) Do Food Safety Requirements imposed by China have a negative effect on the country´s food imports? b) Can Latin American exporters of fresh fruits deal with the Food Safety Requirements imposed by China? After analyzing several research papers and databases related to non-tariff measures, the author found enough evidence to state that the Food Safety Requirements imposed by China do have a negative effect on food imports. Additionally, the situational analysis of Latin American Food Safety Systems helped identify the potentials and weaknesses of the region to face those complex requirements.
