The main conclusion was that: the legal implications of the use of videoconferencing in the Peruvian criminal process in the year 2020 were determined. First, the use of videoconferencing in oral proceedings contravenes the principle of publicity, already according to the protocol regulated by administrative resolution of the aforementioned Judicial Power in this work, they resemble the criminal trial as a private trial that no longer guarantees its publicity. Second, it also damages the right of defense, from two perspectives: first, that a private, direct and fluid communication between the accused and his defense attorney is not ensured; A second aspect that also damages the right of defense, is when the lawyer performs a cross-examination of a witness, for example, which would be limited to the data traffic of the device that it has, being able to lose the fluidity of said vital action in the defense.
