La competencia de los jueces de paz letrados laborales de la Corte Superior de Justicia de Cusco y las pretensiones no cuantificables en la nueva ley procesal del trabajo

Abstract

La legislación laboral es una herramienta muy importante para la defensa y la solución de problemas en materia laboral en este trabajo se tuvo como propósito analizar y estudiar sobre la facultad competencial de los Jueces de Paz Letrados Laborales a la luz de la Ley N° 29497 (NLPT) en este caso referidos a las pretensiones que por su naturaleza y contenido no son cuantificables; para ello se utilizó un enfoque cualitativo documental puesto que se estudia un fenómeno que se da en la realidad, asimismo se tomó en consideración 4 procesos judiciales respecto a la materia, el tipo de investigación jurídica fue el dogmático exploratorio puesto que se trata de un tema novedoso del cual no existen muchas investigaciones previas. Finalmente debo señalar que en la actualidad los jueces de paz letrados laborales toman competencia sobre materias no cuantificables a pesar de que esta no está permitida en la ley; por lo tanto, es necesaria realizar una modificación en la ley 29497 que avale tal actuar siendo que esta se va dando en la realidad.

Labor legislation is a very important tool for the defense and solution of problems in labor matters. In this work, the purpose of this work was to analyze and study the competence of Justices of the Peace Labor Lawyers in light of Law No. 29497 ( NLPT) in this case referring to claims that by their nature and content are not quantifiable; For this, a qualitative documentary approach was used since a phenomenon that occurs in reality is studied, also 4 judicial processes were taken into consideration regarding the matter, the type of legal investigation was the exploratory dogmatic since it is a topic novel of which there are not many previous investigations. Finally, I must point out that currently labor lawyers justices of the peace take jurisdiction over non-quantifiable matters despite the fact that this is not allowed by law; therefore, it is necessary to make a modification in law 29497 that endorses such an act since it is taking place in reality.
