Mining plays an especially important role in the Cusco region where it is estimated that mining contributes to 16% of GDP. However, the end of the commodities supercycle has forced the government to take pro-economic growth measures. One of them was the enactment of Law 30230, which removed the Environmental Inspection and Evaluation Agency (OEFA) from the power to sanction mines that violate environmental regulations with fines. The objective of this study is to determine the effect of less environmental regulation on the dynamics of mining production for the period 2009-2019. The research has an explanatory scope, with a correlational design and a quantitative approach. Information is used from the mining production report from the Ministry of Energy and Mines, development indicators from the World Bank and the Commodities markets report from the World Bank, with a sample of 160 observations per mining company-year. The analysis uses an interrupted time series model to identify the effect of the enactment of Law 30230 on the dynamics of Silver, Copper and Gold production in July 2014. The results suggest that less oversight by OEFA and a less environmental regulation had positive effects on production. The results are statistically significant with a p-value between 0.10 and 0.01. It is found that the production of silver and copper increased by 2,332 fine kilograms and 135,124 fine tons respectively after the enactment of Law 30230, at the cost of greater environmental pollution in the Cusco region.
