This professional sufficiency report has been carried out with the main objective of evaluate the technical criteria applied by OEFA in determining fines for environmental violations in the fishing industry during the period 2017-2022, to reduce the economic penalty by identifying violations recurring and technical graduation factors.A total of 492 procedimientos administrativos sancionadores (PAS) files were analyzed, the data of which was provided by the OEFA transparency office and complemented with the single registry of sanctioned environmental offenders (RUIAS, registro único de infractores ambientales sancionados) obtained from the open data website of the same institution. By this was possible to identify that 169 companies faced administrative sanctioning proceedings (PAS) with 1,136 alleged acts linked to fifteen categories of environmental infractions. Three of it were the most recurrent, representing 74.30% of the infractions of high relevance, 11.27% of infractions had medium relevance and 14.44% low relevance. Despite the large number of breaches detected, in general terms the alleged acts have decreased year after year. In relation to the technical criteria applied to calculate the fine, according to the methodology approved by the Board of Directors Resolution No. 024-2017-OEFA/CD, it is concluded that the variables graduation factors (F) and illicit benefit (B) could be discussed by the administrators during the presentation of their defenses, since they are mostly related to the actions and expenses carried out by them to minimize and/or adapt the effects generated by the infringing conduct; that could be traduced in an economic reduction of the total value of the fine imposed.
