Abstract: El presente trabajo tiene como objetivo central el análisis del efecto de la regulación de tarifas portuarias mediante la metodología de precios tope sobre la sostenibilidad de la oferta de los servicios portuarios ofrecidos en el Terminal Portuario de Paita (TPP). En este ejercicio, se tiene por objeto el análisis de los efectos de la aplicación del factor de productividad (Factor X) sobre la estabilidad económica y financiera del Concesionario, Terminales Portuarios Euroandinos S.A., encargado de la administración de TPP. La hipótesis planteada es que el efecto de la regulación de tarifas ha sido favorable para el caso de TPP bajo el factor X aplicado. La evidencia muestra que tal efecto ha sido positivo para TPP en base a sus ratios financieros de solvencia y rentabilidad, así como la evolución de su rating crediticio y el cumplimiento sobresaliente de sus compromisos de inversión. Sin embargo, se muestra, también, los eventuales efectos adversos que ocasionaría la aplicación de un factor de productividad distinto como el que propuso inicialmente el regulador basándose en su discrecionalidad. Finalmente, se concluye resaltando el hecho de que más allá de considerar aspectos metodológicos, el regulador juega un rol importante para crear un entorno de confianza y predictibilidad para que se logre el objetivo máximo de asegurar la oferta del bien público en beneficio de la sociedad.
The objective of this paper is to the analyze the effect of the regulation of port tariffs through the price cap methodology on the sustainability of the supply of port services offered in the Paita Port Terminal (PPT). The analysis focuses on the effects of how the productivity factor (Factor X) is calculated and applied on the economic and financial stability of the Concessionaire, Terminales Portuarios Euroandinos S.A., in charge of the port administration. The hypothesis proposed is that the effect of rate regulation has been favorable for the PPT case under the X factor applied. The evidence shows that this effect has been positive for PPT based on its financial solvency and profitability ratios, as well as the evolution of its credit rating and outstanding compliance with its investment commitments. However, this paper also shows the eventual adverse effects that a different productivity factor would cause, such as the one initially proposed by the Regulator based on its discretion. Finally, it is concluded by highlighting the fact that beyond considering methodological aspects, the regulator plays an important role in creating an environment of trust and predictability to achieve the objective of ensuring the supply of the public good for the benefit of society is achieved.
