Anticompetitive practices generate losses of social efficiency and an inefficient allocation of resources; therefore, such conducts must be correctly identified and repressed. In Peru, the Free Competition Commission (FTC) is the administrative instance in charge of this. This study seeks to analyze the decision of the CLC in the Resolution 014-2022/CLC-INDECOPI, where it determined that the companies involved incurred in an interbrand horizontal collusive practice, in the market of whole turkey San Fernando at national level, during the period between 2009 and 2016. For this purpose, the key concepts used in the Resolution and their interrelation were defined and, the arguments that led the FTC to make its decision were reviewed. It was found that the alleged unlawful practice is a vertical intra-brand restriction and not horizontal inter-brand collusion under the hub and spoke scheme, as the FTC had determined. Likewise, similar cases in Peru and Chile were analyzed, which support why the present analysis is correct. Finally, empirical literature is presented on how the determination of involvement in an illegal practice results in reputational damage for the implicated companies.
