Electric services are indispensable for the population; therefore, it is vitally important to establish a regulatory framework that provides incentives to improve the electrical service for end users, complying with the minimum quality standards stipulated in the Technical Standard for the Quality of Electrical Services (NTCSE, as per Spanish acronym), such as maintaining a constant voltage level with a 5% variation, reducing the frequency and the duration of interruptions in electrical service, etc. This work will investigate, compare, analyze and conclude whether the changes of the efficient business model applied by Osinergmin since november 01, 2018 has the neccessary characteristics to deal with the problem of distribution added value (VAD, as per Spanish acronym) determination. The importance of this lies in the need to fulfill, in an optimal way, the requirements of an uninterrupted electric service for the end users, and, in addition, to provide monetary incentives to the electric distribution companies to improve their resource management. The hypothesis presents that new VAD model can be improved in the points of article 67 of the Electrical Concessions Law (LCE, as per Spanish acronym), modified by the Legislative Decree N0. 1221, which apply efficiency criteria for companies with more than 50 thousand users, since the regulation can become very strict with respect to its criteria such as considering infrastructure materials at lower than the real cost.
