Abstract: La presente investigación contiene temas relacionados al divorcio por causal,
establecido en el Código Civil Peruano (1984), en el cual trata del adulterio como una causal de divorcio, sin embargo esta norma solamente lo señala como una causal de divorcio o separación de cuerpos, más no la define taxativamente.
De esa manera, podemos señalar lo establecido en el artículo 333° del Código
Civil Peruano (1984), el cual señala que: “Son causas de separación de cuerpos: 1. El adulterio. (…)”, en concordancia con el artículo 349° de la misma norma, el cual señala que: “Puede demandarse el divorcio por las causales señaladas en el Artículo 333, incisos del 1 al 13.”Como se puede ver, el CCP establece como causal de divorcio, al adulterio, pero debido a la dificultad para probarlo ante los órganos jurisdiccionales, no brinda la seguridad jurídica al cónyuge ofendido para poder invocarlo, pero ello debido a que no se tiene enmarcada su definición, lo cual nos ayudaría a determinar en qué momento es que se configura el adulterio, a menos que en nuestra legislación el adulterio se considere como tal cuando producto de la relación extramatrimonial hayan procreado un hijo.
El divorcio existe desde épocas antiguas y el adulterio como causal de divorcio
fue comprendido también desde mucho tiempo atrás, señalando la doctrina al
adulterio como la relación sexual con persona de otro sexo, estando este casado (a), la cual además ha estado configurado en otras legislaciones, como causa de la disolución del vínculo matrimonial, sin embargo, se sabe que en la práctica esta causal es la menos usada, ya que al momento de probarla, por decirlo así, es casi imposible, motivo por el cual este trabajo de investigación aborda dicho tema, que a su vez se estudia detalladamente, tratando los puntos más importantes para establecer una definición elocuente a nuestra realidad, del que se pueda deducir la forma de su probanza, que finalmente nos llevará a una propuesta de incorporación legislativa en el Código Civil Peruano (1984).
The present investigation contains subjects related to the divorce by cause, established in the Peruvian Civil Code (1984), in which it treats of the adultery as a causal one of divorce, nevertheless this norm only indicates it as a causal of divorce or separation of bodies, But does not define it exhaustively. In this way, we can point out what is established in article 333 of the Peruvian Civil Code (1984), which states that: “They are causes of separation of bodies: 1. Adultery. (...) “, in accordance with article 349 of the same rule, which states that:“ A divorce may be demanded for the reasons indicated in Article 333, paragraphs 1 to 13. “As can be seen, the CCP establishes As a cause of divorce, to adultery, but because of the difficulty of proving it before the courts, does not provide the legal security to the offended spouse to be able to invoke it, but this because its definition is not framed, which would help us to determine At what point is adultery established, unless in our legislation adultery is considered as such when the product of the extramarital relationship have procreated a child. Divorce has existed since ancient times and adultery as a cause of divorce was also understood for a long time ago, pointing to the doctrine of adultery as the sexual relation with person of another sex, being this married, which has also been configured in Other laws, as a cause of dissolution of the marriage bond, however, it is known that in practice this causal is the least used, since at the time of proving it, so to say almost impossible, which is why this research work addresses. This issue, which in turn is studied in detail, addressing the most important points to establish a definition eloquent to our reality, from which can be deduced the form of its probation, which will eventually lead us to a proposal for legislative incorporation in the Civil Code Peruvian (1984)
