El contrato laboral y la vulneración de derechos laborales del personal de serenazgo en la Municipalidad Distrital de San Sebastián, Cusco 2021-2022

Abstract

El objetivo de la investigación fue determinar los efectos que produce el decreto legislativo Nº 1057 en los derechos laborales del personal de serenazgo de la Municipalidad Distrital de San Sebastián, Cusco durante el período 2021-2022. La metodología utilizada fue de enfoque cualitativo, tipo básica, diseño no experimental y alcance descriptivo. Para llevar a cabo la investigación, se analizaron los contratos laborales del personal de serenazgo de la Municipalidad distrital de San Sebastián y se realizaron 6 entrevistas a especialistas abogados en la materia. Se utilizaron técnicas de entrevista y análisis documental, con los instrumentos de ficha de análisis documental y guía de entrevista. Los resultados encontrados indican que el Decreto Legislativo Nº 1057 ha generado efectos significativos en los derechos laborales del personal de serenazgo de la Municipalidad Distrital de San Sebastián, Cusco. Los entrevistados resaltan la importancia de proteger los derechos laborales de este grupo esencial, que brinda servicios de seguridad y vigilancia a la comunidad. Se observó que las contrataciones bajo el régimen CAS pueden tener ventajas económicas o de flexibilidad para la entidad municipal, pero parecen afectar negativamente las condiciones laborales de los serenos. Además, se encontraron disparidades en cuanto a beneficios y estabilidad en comparación con el Decreto Legislativo 728. Por lo tanto, se considera necesario que las autoridades competentes revisen y reconsideren las modalidades de contratación del personal de serenazgo, buscando un marco que garantice tanto la eficiencia administrativa como el respeto irrestricto de los derechos laborales.

The objective of the investigation was to determine the effects produced by Legislative Decree No. 1057 on the labor rights of serenazgo personnel of the District Municipality of San Sebastián, Cusco during the period 2021-2022. The methodology used was a qualitative approach, basic type, non-experimental design and descriptive scope. In order to carry out the investigation, the employment contracts of the serenage personnel of the District Municipality of San Sebastián were analyzed and 6 interviews were carried out with specialist lawyers in the matter. Interview techniques and documentary analysis were used, with the instruments of documentary analysis sheet and interview guide. The results found indicate that Legislative Decree No. 1057 has generated significant effects on the labor rights of serenazgo personnel of the District Municipality of San Sebastián, Cusco. Interviewees highlight the importance of protecting the labor rights of this essential group, which provides security and surveillance services to the community. It was observed that hiring under the CAS regime may have economic or flexibility advantages for the municipal entity, but they seem to negatively affect the working conditions of the night watchmen. In addition, disparities were found in terms of benefits and stability compared to Legislative Decree 728. Therefore, it is considered necessary for the competent authorities to review and reconsider the modalities of hiring serenazgo personnel, seeking a framework that guarantees both efficiency administration and unrestricted respect for labor rights.
