The general objective of this research was to analyze the impact of the lack of specific regulation of surrogacy in Peru on the constitutional protection of the fundamental rights of the persons involved. The general hypothesis was that this lack of regulation has a negative impact, generating legal uncertainty, vulnerability, and possible violations of the rights to dignity, equality, and reproductive autonomy. The theoretical framework developed and analyzed the relationship between surrogacy and these rights. The research has a qualitative approach, and the results were discussed through legal argumentation supported by the theoretical data. The hypotheses were validated, reaching the conclusion that the lack of specific regulation of surrogate motherhood in Peru has serious repercussions on the constitutional protection of the fundamental rights of all persons involved. The absence of regulations generates evident legal uncertainties, leaving the parties in a state of vulnerability and exposed to possible violations of the rights to dignity, equality, and reproductive autonomy. The main recommendation is addressed to the Peruvian State, urging it to urgently implement specific regulations that comprehensively address surrogacy and protect the fundamental rights of all persons involved. To achieve this, it is essential to establish a clear and comprehensive legal framework that provides legal certainty, protection, and equity to both surrogate mothers and surrogates, respecting their rights to dignity, equality, and reproductive autonomy.
