Análisis de los efectos jurídicos de la prescripción adquisitiva de dominio en sede notarial: estudio en la provincia de Anta, departamento de Cusco

Abstract

El presente trabajo de investigación titulado el análisis de los efectos jurídicos de la prescripción adquisitiva de dominio en sede notarial: estudio en la provincia de Anta, departamento de Cusco, tiene como objetivo general identificar los efectos jurídicos de la prescripción adquisitiva de dominio en sede notarial, en laprovincia de Anta, departamento de Cusco. El diseño empleado y que ha servidocomo referente para ejecutar cada una de las actividades investigativas fue el analítico dogmático. La presente investigación pondrá a prueba los problemas y dificultades que surgen en relación con el procedimiento notarial de usucapión, tomando como referencia la provincia de Anta, departamento de Cusco. Asimismo, se va a analizar y profundizar en el tema del análisis de las leyes mencionadas si estas en verdad alcanzan sus efectos jurídicos y si se llega a inscribirse la prescripción adquisitiva de dominio en los registros públicos para así alcanzar el ansiado título de propiedad de un posesionario. Asimismo, se ha logrado identificar los efectos jurídicos de la prescripción adquisitiva de dominio en sede notarial.

The present research work entitled the analysis of the legal effects of theacquisitive prescription of domain in notarial headquarters: study in the provinceof Anta, department of Cusco, the general objective is to identify the legal effectsof the acquisitive prescription of domain in notarial headquarters, in the provinceof Anta, department of Cusco. The design used and that has served as areference to carry out each of the investigative activities was the dogmaticanalytic.

The present investigation will put to the test the problems and difficulties that arisein relation to the notarial procedure of usucapion, taking as reference the provinceof Anta of the department of Cusco. Likewise, the subject of the analysis of theaforementioned laws will be analyzed and deepened if they really achieve theirlegal effects and if the acquisitive prescription of domain is registered in the publicrecords in order to achieve the desired property title of a possessor. Likewise, ithas been possible to identify the legal effects of the acquisitive prescription ofownership in the notarial office.
