Resumen: La importancia del medio ambiente, se basa principalmente en las condiciones de vida adecuada que le brinda al hombre para su subsistencia, por tanto el daño del cual pueda ser objeto requiere una atención urgente y preferente por el ordenamiento jurídico.
Nuestra legislación ha intentado generar instituciones jurídicas través de las cuales las víctimas puedan invocar una acción jurídica que le permita atribuir responsabilidad a quien fue causante del daño para que este tenga que resarcirlo. Es por ello que independientemente de la responsabilidad penal y administrativa con la que contamos en el ordenamiento jurídico, se crea la responsabilidad civil extracontractual.
Al crear esta institución jurídica el legislador, también ha establecido un plazo que por la inacción de los legitimados para invocar esta acción, se da lugar a la extinción, de la relación jurídica, es decir da lugar a la liberación de responsabilidad.
La determinación de un plazo prescriptorio contiene tal trascendencia, pues de ello depende la tutela efectiva o no de un derecho invocado y más aún en los casos de daños ambientales que son de naturaleza compleja por requerir un tratamiento diferente al daño patrimonial. Es en ese entendido que en la presente investigación hemos abordado la responsabilidad civil extracontractual por daños ambientales para entender la complejidad que contiene esta institución jurídica, seguidamente partiendo de esa premisa hemos abordado el tema central de la investigación que está referido al plazo de dos años el cual fue determinado por el legislador, quien no emitió un argumento razonable de su decisión, pues no se ha publicado ni oficial ni extraoficialmente la exposición de motivos.
Posteriormente, al conocer los alcances del plazo prescriptorio de la responsabilidad civil extracontractual por daños ambientales, se abordó la importancia de la tutela jurisdiccional efectiva para viabilizar el derecho de acceso a la justicia con la finalidad de resguardar el derecho fundamental a un medio ambiente equilibrado para el desarrollo de la vida del hombre. Por tanto se llegó a la conclusión de que los jueces, quienes son los encargados de administrar justicia, deben apartarse vía control difuso, de lo señalado en el artículo 2001 inc. 4 en casos responsabilidad civil extracontractual por daños ambientales a efectos de procurar que la aplicación de un plazo prescriptorio, (que considero insuficiente) y su vencimiento, impidan a un conjunto de personas a presentar sus pretensiones resarcitorias y a obtener en justicia una respuesta del órgano jurisdiccional.
The importance of the environment is mainly due to the adequate living conditions that it offers to human beings for its survival; therefore, any damage that could be done to it need to be attended immediately and prioritarily by the legal order. Our legislation has tried to create legal institutions through which the victims could invoke a judiciary action that would allow them to ascribe the responsibility to whom has caused the damage for which they have to be compensated. That is why, aside from the penal and administrative responsibility that exists in our legal system, a non-contractual civil liability Along with the establishment of this legal institution, the legislator also established a limit term after which, if the victims have not taken legal action, the legal relationship dies out, that is to say the release of responsibility. The establishment of a prescription term is transcendental; of it, depends the effective protection or not of an invoked right, and even more so in cases of environmental damages of complex nature, as it requires a different treatment from a patrimonial damage. In that sense, this investigation addresses the issue of the non-contractual civil liability for environmental damages to understand the complexity of this legal institution. Then, it addresses the main issue of the investigation, which is referred to the limit term of 02 years, determined by the legislator, who did not support it with a reasonable argument; as its motives have not been published, neither officially nor extra officially. Later on, given the importance of the prescriptive term of the non-contractual civil liability for environmental damages, the investigation addresses the importance of an effective jurisdictional protection to make visible the right of access to justice, in order to protect the fundamental right to a balanced environment for the development of human life. Therefore, the conclusion reached is that the judges, who are in charge of administrative justice, muststand aside through fuzzy control, as stated in art. 2001 inc. 4 in cases of noncontractual civil liability for environmental damages, in order to have the application of the term limit(that I consider insufficient) and its expiration keeping a group of persons from submitting their compensatory claims and obtaining a legal answer from the jurisdiction organ.
