Abstract: El presente trabajo de investigación parte de un hecho objetivo que posee matices tanto jurídicos como sociales, nos referimos a la cuantía en el delito de Hurto Simple que está normado en el Código Penal del año 1991, Sabiendo que el Hurto Simple consiste en el apoderamiento ilegítimo de una cosa mueble ajena, que es realizado sin fuerza, ni violencia o intimidación en las personas, caracterizándose por: a) El hurto constituye el tomar una cosa mueble ajena sin la voluntad de su dueño; b) Debe existir un apoderamiento real, tomando el agente una posición igual en todo a la de un propietario, sin reconocimiento jurídico; c) Que el objeto sobre el cual recae la acción sea un bien mueble ajeno y; d) Debe exigir el animus de obtener un provecho propio. La tesis se orienta a los efectos de la comisión del hecho punible (daño) teniendo que, sin perjuicio del valor del bien que se ha hurtado, el daño causado a la víctima puede ser de tal magnitud que incluso ponga en riesgo su subsistencia. En ese sentido la investigación tiene por objeto que se analice, al momento de efectuar la calificación del hecho punible, no solo sobre el bien y/o patrimonio sustraído a la víctima sino también la cuantía que debiera corresponder por el daño causado, existiendo así bienes jurídicos fundamentales como la vida, ejemplo, El delincuente que se apodera ilegítimamente de un resucitador manual –AMBU– usado para ventilar a pacientes con problemas de respiración, así poniendo en riesgo la vida del paciente y otro ejemplo sería el de aquellas personas que solo cuentan con su remuneración mínima vital para hacer frente a la satisfacción de sus necesidades básicas para su subsistencia. Tales delincuentes reciben el tratamiento sólo por faltas porque las normas establecen para que se considere delito se debe superar la remuneración mínima vital.
This research work is based on an objective fact that has both legal and social nuances, we refer to the amount of the crime of simple theft that is regulated in the Criminal Code of 1991, Knowing that theft is simple, empowerment illegitimate of a movable property that is carried out without force, violence or intimidation in people, characterizing itself: a) Theft constitutes the taking of a movable property without the will of its owner; b) There must be a real seizure, which is violated by taking the agent a position equal in all to that of an owner, without legal recognition; c) That the object on which the action falls is an alien movable property; and d) It must demand the animus to obtain its own benefit. The thesis is oriented to the effects of the commission of the punishable act (damage) having, that without prejudice to the value of the property that has been stolen, the damage caused to the victim can be of such magnitude that it even jeopardizes their subsistence. In this sense, the investigation aims to qualify and evaluate, at the time of qualifying the punishable act, it must be analyzed not only in response to the damage that has been caused to the victim but also to the amount that should correspond for the damage caused, thus existing fundamental legal rights such as life, example, (The offender who unlawfully seizes a manual resuscitator -AMBU- used to ventilate patients with breathing problems, thus putting the patient's life at risk and another example would be that of those people who only have their minimum vital remuneration to face the satisfaction of their basic needs for their subsistence). Such offenders receive the treatment only for faults because the rules establish that to be considered a crime the minimum vital remuneration must be exceeded.
