The research contemplates the study regarding the violation of the rights to equality and non-discrimination in light of comparative law in homosexual marriage in Peru, for which the following question is raised: How is the right to equality related and non-discrimination, with the impossibility of homosexual marriage in Peru, in light of comparative law?, having as general objectives: Determine the relationship between the right to equality and non-discrimination, with the impossibility of homosexual marriage in Peru, in the light of comparative law. It proposes a basic quantitative approach methodology with a non-experimental design, using the survey technique for data collection. The results of the research show the existence of impediments to the regulation of equal marriage, based on normative factors, religious factors, social factors and biological factors, being used by legal operators in the rulings of cases that seek the recognition of this marriage within Of the territory. Likewise, it is evident that Peru has been a country that still resists legally legislating equal marriage in its regulations, unlike other Latin American and European countries that already recognize this figure, in respect of the right to equality and non-discrimination. of homosexual people. The conclusion is that the relationship between the Right to equality and nondiscrimination and homosexual marriage in Peru is significantly high, which means the existence of a violation of the right to equality and non-discrimination due to the impossibility of homosexual marriage in Peru.
