Abstract: La presente investigación titulada “Modificación del Art. 176 “B” delito de Acoso Sexual desde la dogmática jurídico-penal, en la ciudad de Iquitos 2022”, ha delimitado como objetivo el determinar si los abogados litigantes de Iquitos, interpretan el delito de acoso sexual, conforme a las categorías dogmáticas tripartita que componen el delito, esto es, desde la óptica de la tipicidad, antijuricidad y culpabilidad, con el propósito de aportar criterios de interpretación con más apego a la ratio legis del tipo penal.
Se trata de un estudio de enfoque cualitativo con un método de investigación básica, empleándose los siguientes diseños: no experimental, ser correlacional y de teoría fundamentada; se ha tenido como escenario o población a los abogados litigantes en materia penal que están agremiados al Colegio de Abogados de Loreto y la muestra fue de diez (10) abogados litigantes en el ámbito penal; la investigación tuvo como técnicas empleadas el análisis documental y la entrevista, y como instrumentos se ha manejado la ficha textual y la guía de entrevista.
Los resultados de la investigación han permitido concluir que, la indeterminación de los elementos objetivos y subjetivos que conforman la estructura normativa del tipo penal de acoso sexual (artículo 176°-B del Código Penal), impiden una correcta y adecuada interpretación del delito sexual, pues el elemento normativo ‹‹de cualquier forma›› acogido en una cláusula numerus apertus no es entendido conforme a la naturaleza del núcleo del tipo, esto acorde al elemento normativo ‹‹actos de connotación sexual›› deben entenderse como conductas sexistas que persigue el sujeto activo, máxime si ello refleja el comportamiento doloso del agente que se extiende a sus propósitos sexuales.
The present research entitled “Modification of the crime of sexual harassment from the legal-criminal dogmatics in the city of Iquitos 2022“, has delimited as objective to determine if the litigating lawyers of Iquitos, interpret the crime of sexual harassment, according to the tripartite dogmatic categories that compose the crime, that is, from the perspective of the typicity, antijuricity and culpability, with the purpose of providing interpretation criteria with more attachment to the ratio legis of the criminal type. It is a qualitative approach study with a basic research method, using the following designs: non-experimental, correlational and grounded theory; the scenario or population was the criminal litigants who are members of the Bar Association of Loreto and the sample was ten (10) criminal litigants; the research techniques used were documentary analysis and interview, and the instruments used were the textual file and the interview guide. The results of the research have led to the conclusion that the indeterminacy of the objective and subjective elements that make up the normative structure of the criminal offense of sexual harassment (article 176°-B of the Criminal Code), prevent a correct and adequate interpretation of the sexual offense, because the normative element ''in any form'' included in a numerus apertus clause is not understood in accordance with the nature of the core of the type, this according to the normative element ''acts of sexual connotation'' must be understood as sexist conducts pursued by the active subject, especially if it reflects the fraudulent behavior of the agent that extends to his sexual purposes.
