The objective of this work was to determine the foundations of marriage in Peru - 2022, addressing the basic type study through a descriptive, nonexperimental and cross-sectional level, using documentary analysis to examine Judgment 172/2022, issued by the Constitutional Court, in file No. 02743-2021-PA/TC, which declared the appeal for constitutional grievance inadmissible in the amparo lawsuit filed by Andree Martinot Serván and Diego Urbina Fletcher so that they can register their marriage in Reniec, concluding that beyond From the procreative meaning of marriage, it is true that the union between a man and a woman has a direct relationship with the subsistence of the species, although other types of unions can be accepted, they should not have the unique characteristics of marriage, which The Constitutional Court has included in the Judgment matter of study, recognizing the validity and legitimacy of article 234 of the Civil Code, despite the interpretations of various international instruments that seem to point towards the validity of equal marriage, but that in our legal system do not prevail over what is mandated by the Constitution, and which serves as the foundation for the conception of only heterosexual marriage that our Civil Code has.
