Abstract: La tenencia compartida apunta a que, tras una separación, el padre y la madre puedan pasar la misma cantidad de tiempo con sus hijos y tengan los mismos derechos sobre su crianza. Para ello, establece que los jueces deben priorizar esta opción. La tenencia exclusiva cuando solo uno de los padres se hace cargo de los hijos y el otro accede a un régimen de visitas pasaría a ser la excepción y no la regla.
La tenencia compartida es un régimen legal que regula la guarda de los hijos de padres divorciados o separados en partes iguales. Este acuerdo permite que los hijos permanezcan con ambos padres la mitad del tiempo. No conviven con uno solo de ellos y pasarán algún día de la semana con el otro.
El presente trabajo, nos mostrara los criterios legales existentes en nuestra regulación, que permiten por sobre todas las cosas proteger el interés superior del niño, niña y adolescente ante la vulnerabilidad por la separación de sus padres y el deber que a estos les acoge.
