The work includes the decision of the First Chamber of the Constitutional Court relapsed in the sentence of the EXP. N. ° 03041-2021-PHD / TC, where from the fifth to the twenty-sixth foundation it explains precisely why its decision was adopted. Mr. Miguel Arévalo Ramírez filed an exclusionary habeas data claim against 9 defendants. As the main petition, it requests to proceed to withdraw or eliminate and cancel your personal data from the indexes, links and among others of the Google search engine. The general objective that is sought when carrying out this work is to explain the way in which the habeas data process protects the right to informative self-determination; which is explained in the theoretical development of the work. The analysis that was carried out to the sentence of the EXP. N.°03041-2021-PHD/TC allows us to identify the way in which this protection mechanism should be used, which is later developed in the conclusions. To achieve the development of the topic, a breakdown of the rights contained in the protection of the habeas data process was made, such as the right to access public information and informational self-determination (protection of personal data). The analysis is also carried out comparing the national jurisprudence that exists on the subject, contained in the present work. Coming to the conclusion that a person included in a data record can request its deletion or correction if such information is false or outdated, without colliding with other rights. The analysis of the information disseminated from a criminal process (preliminary investigation) affects the right to intimacy and privacy is also made. The work contains general international, national and regional background, to achieve a better understanding of how this figure has become relevant in Peruvian laws. It also contains the development and explanation of each foundation that was taken into consideration in the EXP ruling. No. 03041-2021-PHD/TC.
