The present investigation was based on the problem: Does article 565-A of the Civil Procedural Code on the exoneration of alimony violate the right to effective jurisdictional protection, since it is considered an article that obliges and/or conditions the plaintiff to present proof of non-debt? The objective was: To determine whether article 565-A of the Code of Civil Procedure on the exoneration of alimony violates the right to effective jurisdictional protection, since it is considered an article that obliges and/or conditions the plaintiff to present proof of non-debt. The technique used was the survey and the instrument was the questionnaire. The population consisted of 50 litigants from the Province of Maynas and the sample consisted of 44 litigants. The type of research will be quantitative with a non-experimental design of a transactionalcorrelational type. For the statistical analysis, descriptive statistics were used to study the variables independently and the parametric chi-square test (x2) was used to demonstrate the hypotheses. The results indicated that: It is concluded that the requirement of admissibility of the claim for reduction, variation, proration or exoneration of alimony of being up to date in the payment of alimony violates the constitutional right to effective jurisdictional protection and due process, since it restricts the right of the obligor to file a claim, so it would correspond to modify the present article so as not to continue violating the right to effective jurisdictional protection.
