The present investigation was based on the problem: Is Article 293 of the Civil Code on work permits unconstitutional because it violates the freedom of work? And the objective was: To determine if article 293 of the Civil Code on work permit is unconstitutional for violating the freedom of work. The technique used was the survey and the instrument was the questionnaire. The population consisted of 30 trial lawyers of the Province of Maynas, the sample consisted of 28 trial lawyers. The design used in this research is the “non-experimental transactional or transversal type of correlational level“. For the statistical analysis, descriptive statistics were used to study the variables independently and to demonstrate the hypotheses, the parametric chi-square test (x2) was used. The results indicated that: It is concluded that Article 293 of the Civil Code on Freedom of work of spouses, is unconstitutional, for limiting the right to freedom of work and equality, enshrined in our Constitution in Article 22. Having determined the above, we can then indicate that it would be feasible to amend Article 293° Civil Code on work permit.
