The research work that has been developed consists of five chapters in which it can be seen in specific cases the use of the measure of coercion called preventive detention and the impact it has with the violation of the presumption of innocence. It has been proposed as hypothetical assumptions that preventive detention is not necessary in the preparatory and intermediate stages of investigation, because it violates the right to the presumption of innocence by limiting the personal freedom of a defendant, so that this constitutional guarantee, being of a iuris tantum type, is defeated through the resolution of the criminal conflict by a sentence with quality of firmness. We believe that the presentation of the cases analyzed, they help to understand the mechanisms of breakdown and friction to the presumption of innocence as a constitutional guarantee, we have detailed the following aspects in the cases, illegal detention (understood as a case one), the presumption of innocence and reasonable period (case number two), analysis of standard of evidence (case number three), prognosis of worth and the proportion of the measure (case number four) and use of imputations of coimputados in the formation factual criminal case number five), all of them, in a collision the constitutional guarantee of the presumption of innocence. The contribution of this research paper, we consider is of importance due to the use when analyzing cases, the method of interpretation from internal norms and conventional norms, as well as the use of national and supranational jurisprudence. In conclusion, in the five cases analyzed, we have managed to prove the violation of the principle of the presumption of innocence, with a normative and casuistic development presented case by case in three concatenated instances, at the ordinary level, at the constitutional level and at the supranational level.
