Abstract: La presente investigación partió del problema ¿De qué manera la falta de imputación necesaria afecta el debido proceso constitucional en el Distrito Judicial Loreto? Y el objetivo fue: Explicar de qué manera la falta de imputación necesaria afecta el debido proceso constitucional en el Distrito Judicial Loreto. La técnica que se empleó fue la encuesta compuesta de 05 preguntas por cada variable y el instrumento fue el cuestionario de manera directa y personalizada. La población estuvo conformada por 80 abogados litigantes y 10 fiscales penales entre Provinciales y Adjuntos Provinciales – de la Provincia de Maynas. El diseño que se empleo fue de tipo no experimental - transaccional correlacional. Para el análisis estadístico se usó la estadística descriptiva, para el estudio de las variables en forma independiente y para demostración de las hipótesis generales y específicas, se usó la prueba paramétrica chi cuadrado (x2). Los resultados indicaron que: La falta de imputación necesaria afecta el debido proceso constitucional en el extremo de que el acusado desconoce de manera concreta cuales son los cargos por los cuales se los está acusando y de esta manera pueda diseñar la estrategia de su defensa.

The present investigation started from the problem: How does the lack of necessary imputation affect the constitutional due process in the Loreto Judicial District? And the objective was: To explain how the lack of necessary imputation affects the constitutional due process in the Loreto Judicial District. The technique that was used was the survey composed of 05 questions for each variable and the instrument was the questionnaire in a direct and personalized way. The population was made up of 80 trial lawyers and 10 criminal prosecutors between Provincials and Provincial Deputy - from the Province of Maynas. The design used was non-experimental - transactional correlational. For the statistical analysis, descriptive statistics were used, for the study of the variables independently and to demonstrate the general and specific hypotheses, the parametric chi-square test (x2) was used. The results indicated that: The lack of necessary imputation affects due constitutional process to the extent that the accused does not know in a concrete way what are the charges for which they are being accused and in this way he can design his defense strategy.
