The exercise of the jurisdictional function contributes significantly to social peace, so the proper administration of justice is the main pillar for the protection of the fundamental rights of Peruvians. Given the increasing violation of these constitutional rights, Social and Constitutional Chambers, nationwide, have been overwhelmed with cases whose immediate resolution is vital, being rights that can not be valued monetarily, in that understanding, after the deactivation by mode conversion of the Social and Constitutional Chamber of the Superior Court of Justice of Cusco, causes a problem which is relevant to every citizen, because by the time of defending and protecting their Constitutional rights is extremely necessary differentiated procedural protection that it is properly designed to ensure not only the quantity but the quality of decisions from the specialized organs in Constitutional issues; also, this problem generates consequently other conflicts with the administration of constitutional justice as the inhibition of other Constitutional topics. On the other hand, in this decision has not been considered that the courts should aim at specialization, much more important now because constitutional matters has managed to play a leading and vital role in the enforcement and defense of fundamental rights, then, the deactivation of the Social and Constitutional Chamber of the Superior Court of Justice of Cusco means a setback in the specialization of matter, not to mention that it would not be observing the provisions of the Constitutional Code and legal system compared, since specialization of judges is considered as a basic aspect of the judicial career. In this context, and emphasizing in the importance of the defense and protection of fundamental rights and the supremacy of the Constitution, I chose to engage in the present investigation the performance of the Civil Chamber of the Superior Court of Justice of Cusco in 2015, and the proper treatment of the increased case load in it, and its impact on the effectiveness of the administration of constitutional justice because of the deactivation of the Social and Constitutional Chamber of the Superior Court of justice of Cusco, for through this research contribute to the effectiveness of the special procedural protection and delivery of a more beneficial justice for the citizens. The thesis is divided into five chapters: In Chapter I, called The Problem, and according to the required formality, is dedicated to the methodological aspects of research, among other issues includes: The approach of the problem, objectives of the research, the working hypothesis, categories of study, etc.; issues already developed in the research project. In Chapter II, called Theoretical Framework analyze the background of this investigation, citing three antecedents in the national and international level, whose object of study has similarities with the one chosen in this investigation also boarded the theoretical basis, defining terms cited in this research, categories of study design and methodology used. In Chapter III, called Constitutional Protection, develops the theme of the referred constitutional processes in our legal system, content of vital importance, since it allows us to know the elements and components that make up, for better understanding, citing both of the study of traditional and modern doctrine, the dissertation of the topic helps us determine for certain the significance of these constitutional guarantees, and the importance of adequate protection. among the constitutional processes we touch is, in first place, the process of Habeas Corpus, Process Amparo, Habeas Data Process and finally the compliance process, In Chapter IV, entitled Justice and Constitutional procedural burden, it examines both the load or overload litigation in courts and the factors that generate it; also we developed the Constitutional Justice and its effectiveness, addressing the types of Constitutional Justice and resolution. In Chapter V, entitled Increased caseload in the Civil Chamberof the Superior Court of Justice of Cusco, and its impact on the effectiveness of the administration of Constitutional Justice in 2015, strictly speaking, this Chapter constitutes validation of our goals and our hypothesis, conducted didactically and easy to read.
