Worldwide there is a conflict between the Right to life and the Right to a dignified death, a controversy that has generated debate among doctors, lawyers and even people themselves.Years after years in the development of science and what life evolves, doctors and scientists through research gave and made known a series of terminal and degenerative diseases. That for reasons of professional ethics, many countries are prohibited from applying Euthanasia (assisted death) to patients, so they only have to give them gradual care until life itself is consumed.Thus, many people must endure inhuman and cruel treatment during the course of the disease, their rights being violated such as: to die with dignity, to their dignity, autonomy and the free development of their personality. Because they are assisted by nurses or technicians for their advanced disease they suffer from. They are also sedated, having to insert a series of medical instruments so that they can live or at least keep them alive. But what do we call living? Can it be called life, suffering from pain? Can it be called life not having intimacy, being assisted by another person?. Many countries such as the Netherlands, Belgium, Colombia and Canada, among others, have legalized Euthanasia as a mechanism to end people's lives. In Peru, on February 22, 2021, the Superior Court of Justice of Lima, through the Eleventh Constitutional Court, issued a judgment declaring the claim for Amparo Action filed by the Ombudsman's Office founded in part. Sentence that caused controversy among all citizens and especially among lawyers, because it was requested that article 112 of the Penal Code be not applied in the case of Ana Estrada Ugarte. Therefore, Euthanasia will be practiced only in the case of Ana Estrada. This being said a big step in the country in relation to the subject, and a good precedent.
