Inaplicación de la Ley N° 28036, el D.S. 014-2022-MINEDU y la vulneración del derecho al deporte, en la Municipalidad Distrital de San Sebastián, Cusco periodo 2022

Abstract

El objetivo general de la presente investigación fue analizar la inaplicación de la Ley N°28036, el D.S. 014-2022-Minedu y su influencia en la vulneración del derecho al deporte en la Municipalidad Distrital de San Sebastián, Cusco periodo 2022 Se utilizo la siguiente metodología, el tipo de investigación es cualitativa, planteada desde un alcance descriptivo. Las técnicas que se utilizaron fueron observación estructurada realidad, las encuestas inestructuradas y la revisión documental para todas las categorías de estudio, la territorialidad de investigación es la Municipalidad Distrital de San Sebastián de la provincia y departamento del Cusco y sus centros recreacionales La Municipalidad Distrital no ha aplicado la Ley N°28036 Ley de Promoción y Desarrollo del Deporte y el Decreto Supremo 014-2022-MINEDU, y es esta la razón por la cual se ha vulnerado el derecho al deporte; ya que, la adecuada aplicación de estos cuerpos legales, si influye positivamente en el ejercicio del derecho al deporte.

The general objective of this research was to analyze the application of Law No. 28036, D.S. 014-2022-Minedu and its influence on the violation of the right to sport in the District Municipality of San Sebastián and province of Cusco period 2022 It uses the following methodology, the type of research is qualitative, raised from a descriptive. The technical data that can be used for real observations, instructive studies and documentary review of the study categories, territorial investigations and the municipalities of San Sebastián and recreational centers. The District Municipality has not applied Law No. 28036 Law for the Promotion and Development of Sports and Supreme Decree 014-2022-MINEDU, and this is the reason why the right to sport has been violated; since, the adequate application of these legal compendium’s, if it positively influences the exercise of the right to sport.
