La ejecución de la medida de seguridad de internación de inimputables en el Establecimiento Penal de Varones del Cusco

Abstract

La presente tesis tiene como objetivo principal determinar si la ejecución de la medida de seguridad de internación en el establecimiento penal de varones del Cusco vulnera los derechos fundamentales del inimputable, toda vez que en esta región como en muchas otras del Perú, no existe Hospital Psiquiátrico público, u otro hospital que brinde el servicio de internamiento para enfermos mentales. Así pues, el principal problema de la presente investigación se centra en lo establecido por el artículo 74° del Código Penal, el cual señala que la medida de seguridad de internación debe ejecutarse en un centro hospitalario especializado u otro establecimiento adecuado, sin embargo, como se verá en el desarrollo de la presente, la medida de seguridad de internación se viene ejecutando en condiciones deplorables y hasta cierto punto discriminatorias que terminan vulnerando derechos fundamentales de una población relegada y olvidada por la política nacional,. En ese orden de ideas, cabe señalar que las personas declaradas inimputables, tienen derechos reconocidos por la Constitución Política del Perú, tales como el derecho a la dignidad y el Derecho del discapacitado de acceso a la salud, sin que hasta la fecha exista un mínimo interés por parte de los diferentes aparatos estatales para dar atención a un sector de la población que sufre estigmas sociales y que en muy pocas ocasiones ha sido tema de debate. Por último, es menester señalar que las condiciones carcelarias en nuestro país son lamentables, siendo este el lugar donde muy penosamente se viene ejecutando la medida de seguridad de internación en la región Cusco.

The main objective of this thesis is to determine whether the execution of the security measure of hospitalization in the criminal establishment of men in Cusco violates the fundamental rights of the unimpeachable, since in this region, as in many other areas of Peru, there is no Psychiatric Hospital public, or another hospital that provides the internment service for the mentally ill. Thus, the main problem of this investigation focuses on the provisions of Article 74 of the Criminal Code, which states that the security measure of hospitalization must be carried out in a specialized hospital or other appropriate establishment, however, as will be seen in the development of this, the measure of security of hospitalization is being carried out in deplorable conditions and to a certain extent discriminatory that end up violating fundamental rights of a population relegated and forgotten by the national policy, nevertheless its rights are recognized by the Political Constitution of Peru, such as the right to dignity and the right of the disabled access to health, without there being at least a minimum interest on the part of the different state apparatuses to give attention to a sector of the population that suffers social stigmas and that very rarely has been the subject of debate. Finally, it is necessary to point out that the prison conditions in our country are lamentable, this being the place where the security measure of hospitalization in the Cusco re gion is being implemented.
