The present research work analyzed the Labor Cassation No. 1538-2021-LIMA, in which Mr. Jorge Arturo Zúñiga Ordóñez sued Telefónica del Perú S.A.A. having as main claim the payment of social benefits, among them the Compensation for Time of Services (CTS) and profits, based on the concept of the Result and Performance System (SRD). The first chapter summarizes the relevant facts of the case, the petition, the arguments of the parties, as well as the pronouncement of the Second Constitutional and Social Transitory Chamber of the Supreme Court of Justice of Peru; it describes the foundations of the concept of the “Results and Performance Evaluation System (SRD)”, which is framed as a remunerative concept and therefore its incidence on social benefits. Also, the singular vote issued by one of the judges is examined. From the doctrine, jurisprudence and regulations consulted in Chapter II, it is concluded in Chapter III that the concept of “Results and Performance Evaluation System (SRD)” is considered extraordinary and not a remunerative concept, and therefore does not affect social benefits.
