This research work has been developed from a basic explanatory methodology, with the aim of analyzing the exorbitant prerogatives contained in article 178.2 of the .D.S. N ° 377-2019 EF and its impact on the principle of the economic and financial equilibrium of the contract. For this purpose, the compilation of international and national antecedents was used, the compilation of bibliography that constitutes the theoretical bases, the variables were developed under a cross-sectional methodology, likewise, the opinion of experts, the opinion guide were used as instruments, of OSCE and the analysis of practical cases. In the light of the investigation, in the state contracting through the administrative contract of a synalagmatic nature, a scenario of inequality between the contractor and the Public Administration is glimpsed, since the latter has a preponderant position, for which the contractor only adheres its will to the conditions previously established. In this sense, it was concluded that the exorbitant prerogatives contained in article 178.2 of .D.S. N ° 377-2019 EF, generate an imbalance in the contractual relationship, which is why an equivalent regulation is necessary, since the existing regulations have proven to be disproportionate, being a guarantee in favor of the State.
