The present investigation entitled "FAILURE OF THE FAMILY COURTS OF THE JUDICIAL DISTRICT OF CAJAMARCA WITH SUPERVISING THE TIMELY EXECUTION OF THE PROTECTION MEASURES GRANTED IN THE FAMILY VIOLENCE PROCESSES IN THE YEARS 2019 AND 2020", had the purpose of determining whether the family courts of the Cajamarca judicial district comply or not with supervising the timely execution of the protection measures granted in the 170 judicial processes (sample) of family violence corresponding to the years 2019 and 2020, in accordance with the provisions of Law No. 30364 - Law to prevent, punish and eradicate violence against women and members of the family group, and its DS Regulation 004-2020-MIMP, article N ° 23-C and article N ° 38 respectively: COMPLIANCE REPORT OF THE PROTECTION MEASURE.- “The National Police of Peru or other entities in charge of executing the protection measure refer to the family court a report on the execution of the measure, within fifteen (15) days from the date it was notified, with the recommendations they deem pertinent. In cases of severe risk, said report must be sent within five (5) days from the date the protection measure was notified. Additionally, every six (6) months, in cases of mild or moderate risk, and every three (3) months, in cases of severe risk, counted since the protection measure was notified, the entities in charge of executing the measure protection authorities send to the family court a report on compliance with said measure and on the victim's risk situation, with the recommendations they deem pertinent. The family court that does not receive the aforementioned reports within the indicated deadlines, communicates this situation to the head of the respective entity, in order to determine the corresponding responsibilities (…)”.
