The objective of this thesis was to analyze the current situation of the crime of omission of family assistance in the framework of non-compliance with food duties in the Superior Court of Justice of Callao 2017-2018. For the fulfillment of the objective, the research methodologically was developed under the qualitative approach, through the type of explanatory research, grounded theory design and the population was made up of the Magistrates and Specialists of Causes of the Criminal Module of the Superior Court of Justice of Callao. The technique used to collect information was the interview and the data collection instrument was the interview guide, which was duly validated through the judgment of experts by Mgtr. Jimmy Márquez Moreno, a professor at the Universidad Privada del Norte, who determined its reliability and validity. It was concluded that in 2017 and 2018 there was a progressive increase in complaints for the crime of omission of family assistance and procedural overload in the processing of the same in the Superior Court of Justice of Callao, this despite having criminalized non-compliance of food duties (art. 149 CPP) and this conduct having been integrated into the cases of application of Legislative Decree No. 1194 (Immediate Process), on August 30, 2015, whose purpose is the simplification, speed of the process and the reduction of the procedural burden significantly.
