Abstract: Mediante jurisprudencia y doctrina se determina que las familias ensambladas son parte actual de la sociedad, conociéndose como una estructura familiar donde uno o ambas parejas tienen hijos (as) nacidos de compromisos anteriores. Es este sentido, es que la investigación tuvo inicialmente como objetivo determinar la situación jurídica de las familias ensambladas en el código civil peruano. Para alcanzar el fin de la tesis, se desarrolló de forma cualitativa, siendo una investigación de tipo básico, con un diseño no experimental. Asimismo, se acopiaron datos mediante entrevistas, en las cuales participaron conocedores en la materia civil y familiar, para recopilar sus respuestas en torno al tema de investigación, a su vez, se realizó un análisis de diferentes sentencias en relación con el tema que fueron emitidas por el Tribunal Constitucional; y una indagación documental con relación al objetivo de esta investigación. Con dicha información, los resultados y conclusiones de la investigación fue que esta estructura familiar es ausente en la normativa peruana, lo cual genera que los miembros que la conforman no cuenten con una tutela jurídica, vulnerando su derecho de protección familiar.

In this sense, it is that the investigation initially has the objective of determining the legal situation of assembled families in the Peruvian civil code. To reach the end of the theses, it was developed in a qualitative way, being a basic type of research, with a non-experimental design. Likewise. Data was collected through interviews, in which experts in civil and family matters participated, to collect their responses regarding the research topic, in turn, an analysis of different sentences in relation to the topic that were issued was carried out by the constitutional court, ant a documentary inquiry in relation to the objective of this investigation. With this information, the results and conclusions of the investigation were that this family structure is absent in Peruvian regulations, which means that the members that make it up do not have legal guardianship, violating their right to family protection.
