In the present investigation related to the legitimacy of the victim to file the defense mechanism "Guardianship of Rights" in case their rights are affected, it has generated a controversial debate within the doctrinal and jurisprudential sector, for this reason it was proposed as With the objective of determining the legitimacy of the victim to file the protection of rights as a procedural defense mechanism in criminal proceedings in our country today, to comply with this, a review was made in reliable data sources such as Google Scholar, Redalyc, Renati, Alicia, virtual libraries of universities, among others; to obtain information relevant to this investigation. Taking as inclusion and exclusion criteria for our population (sample and experts) such as: Law, Experience, Age, Criminal Matters; Thus, as an object of study, the nature and application of the Protection of rights in violation of rights. Where it emerges as a more relevant result that the victim or aggrieved party has a constitutional legitimacy, making a broad interpretation of article 71 of the NCPP; making use of an interpretation conforming to the constitution; because it has constitutional legitimacy in article 2, numeral 2, which refers to the principle of equality of persons and thus concluding that the legitimacy of the victim to file protection of rights is constitutionally based on a broad application of art. 71 of the NCPP and in accordance with art. 2nd numeral 2 of the constitutional interpretation.
