Abstract: El presente informe jurídico analiza la Sentencia emitida por el Pleno del Tribunal
Constitucional en la cual se señala que el internamiento involuntario de una persona
con discapacidad mental, como lo son los casos de aquellas personas que tienen un
diagnóstico de esquizofrenia, queda justificado más allá de lo que ha tipificado la ley
en la materia y que dota a todas las personas con discapacidad de capacidad jurídica
para el pleno disfrute de sus derechos y para ser tratados en igualdad de condiciones
que el resto de personas. Así, en los argumentos que se esbozan en la referida
sentencia hemos podido advertir que dicho fallo vulnera diversos artículos de la
Convención Internacional sobre los Derechos de las Personas con Discapacidad
como de la normativa peruana vigente.
Considerando que las personas con discapacidad son un grupo históricamente
vulnerable y discriminado, no nos encontramos de acuerdo con la postura del Tribunal
Constitucional, que se aleja del modelo social y que garantiza los derechos de las
personas con discapacidad a ser tratadas en igualdad de condiciones que el resto de
personas para que de esa manera pueda desarrollarse y vivir una vida digna y plena.
This legal report analyzes the Judgment issued of the Constitutional Court, which states that the involuntary hospitalization of a person with mental disabilities, such as those persons diagnosed with schizophrenia, is justified beyond what is established by the law in the matter, and that it grants all persons with disabilities legal capacity to fully enjoy their rights and be treated on equal terms with other people. has been established by law on the matter and which provides all persons with disabilities with legal capacity to fully enjoy their rights and to be treated on an equal footing with other people. Thus, in the arguments outlined in the aforementioned sentence, we have observed that this ruling violates various articles of the International Convention on the Rights of Persons with Disabilities as well as current Peruvian regulations. Considering that people with disabilities are a historically vulnerable and discriminated group, we do not agree with the position of the Constitutional Court, which distances itself from the social model and the guarantee of the rights of people with disabilities to be treated on equal terms that the rest of the people, in order for them to develop and live a dignified and fulfilling life.
