According to the content of the Law of the National System of Environmental Impact Assessment – Law N° 27446 and its amendment, preventive environmental management instruments are prospective, this allows that during the execution of investment projects these environmental tools may require modifications or extensions that will be processed after the start of operations. However, the modification or updating of these environmental tools is not a characteristic of preventive environmental management instruments but also corrective environmental management instruments, the latter are environmental management instruments complementary to the National System for Environmental Impact Assessment. So, based on the dynamic nature of preventive environmental management instruments, this work seeks to provide a proposal for an interpretive criterion to the Supervisory Authority, to apply the principle of benign retroactivity in relation to the modification or expansion of these instruments. To achieve the proposed objective, the different pronouncements issued by the Directorate of Enforcement and Execution of Incentives and the Environmental Enforcement Court of the Evaluation Agency will be analyzed and Inspection Environmental in order to analyze the two different approach raised. In conclusion, based on the analysis of jurisprudential normative sources and doctrine, we will defend criteria that are in accordance with the feasibility of applying benign retroactivity in the new environmental management tool.
