This study focuses on the issue of untimely interventions with incriminated phones in red-handed arrests for kidnapping in Peru, highlighting the need to optimize legal and technological processes against this crime. The research emphasizes the growing concern for security and the perception of inefficacy in government responses to crime. It addresses how the technological revolution, while providing valuable tools for organized crime, also represents a significant opportunity for authorities in the fight against kidnapping and extortion. Through detailed analysis, including interviews with experts and examination of specific cases, this study aims to overcome the challenges faced by authorities due to biased legal interpretations and bureaucratic aspects, which prevent rapid and effective action in the intervention of communications and the handling of involved electronic devices. The main goal is to develop an action framework that allows authorities to act more efficiently, highlighting the importance of solid interinstitutional collaboration among the National Police, the Judiciary, and the Public Ministry in combating this increasingly violent crime. The study proposes a review of current procedures and the implementation of innovative strategies aligned with principles of justice and procedural efficiency. The research concludes by emphasizing the need for an integrated strategy that involves the use of advanced technology and legislation adapted to current challenges, to ensure timely and effective intervention in kidnapping cases.
