The present legal report concerns the regulatory systematization in the country, focusing on how Administrative Law addresses an issue in Social Security, specifically related to the right to a retirement pension generated from a Free Informed Disaffiliation (hereinafter "LDI") procedure. This issue arises due to the lack of uniformity and regulations regarding the criteria for establishing the pension start date and pension payment date by the Office of Pension Standardization (ONP), which adversely affected the insured due to the absence of clear rules on the requirements to obtain benefits on the estimated dates. As a consequence of various LDI requests, an-appeal was filed against the first-instance resolution No. 17854-2018-ONP/DPR.GD/DL19990 dated April 23, 2018. Thus, based on the case in File No. 12300282017, dated December 13, 2018, the Administrative Tribunal of Pensions (TAP) approved a mandatory precedent, establishing two rules: as the first rule, the pension begins when the contingency occurs, that is, at the moment the claimant meets the legal requirements to access a pension; and regarding the pension payment date, the second rule states that it is established at the moment of requesting the LDI, provided that the claimant meets the legal requirements to access the pension. These aforementioned rules were subsequently included in paragraph 11 of Article 10 of the Unified Regulation of the legal norms governing the National Pension System.
