The thesis is focusing in exceptions to the rule of exclusion of illegal evidence and violation of fundamental rights jurisdiction of Huaral. In recent decades, both in our country and compared systems, the fundamental guarantees have begun to be taken seriously for the whole judicial activity of the State. Within these guarantees, we have to ban illegal evidence, which prevents evidence obtained in violation of fundamental rights is accepted. Now it is undeniable that currently exists in comparative law a more relative to the exclusionary rule of evidence obtained in violation of fundamental rights that can not be avoided where our Peruvian reality is presenting relevant doctrine and jurisprudence. This research outlined, aims to unify the criteria to be used to determine the causes of justification in cases related to the exceptions to the exclusionary rule prohibited and illegal evidence, based on the opinion of legal practitioners, the comparative law, as the American-Spanish and national school. In this context, the objective of our thesis is to determine the incidence of exceptions to the rule of exclusion of illegal evidence in violation of fundamental rights. The research is not experimental, descriptive design with correlating, where the technique of the survey of the legal practitioners of the courts and provincial corporate criminal prosecution of Huaral, concluding were used that exceptions to the rule excluding illegal evidence positively affect the violation of fundamental rights.
