Introduction: In Peru, various groups such as indigenous communities, rural communities and workers protest to change policies that affect the population, generating conflicts with security forces and demanding to be heard. Objective: Identify how human rights influence protests as peaceful demonstrations in Lima, during the period 2020-2023, considering the social and political context. Methodology: The research is qualitative, with an inductive 8 approach. The design is a case study, using the analysis of File No. 01492-2022-PHC/TC, which addresses legal and fundamental rights aspects. As a result: they showed that peaceful demonstrations are fundamental for human rights, but conflicts with the police generate violence and tensions. In conclusion: Human rights are essential in peaceful demonstrations, as they guarantee freedom of expression and assembly, strengthening democracy and civil society. It is crucial to strike a balance between the protection of these rights and the preservation of public order, while ensuring the protection of the rights of all citizens. To achieve this, a constructive dialogue must be promoted between the parties, which will contribute to a more peaceful and effective management of the protests.
