The general objective of this thesis report is to determine if it is necessary to limit the scope of the parental relationship of the active subject in the crime of child abduction to justify the elements of the crime in the preparatory investigation phase, Fiscal District La Libertad, Period 2018-2020. The methodology used was basic and descriptive, the exegetical, legal hermeneutic and dogmatic methods were applied, the techniques applied were the documentary analysis of prosecutorial folders and the interview to legal operators. As for the most important results of the investigation, there is an extension of the family connection in the individual who commits the illicit act of kidnapping a minor, by incorporating as perpetrators relatives who did not have a close material relationship with the minor. This expansion leads to situations in which impunity prevails, as the cases are often archived because they do not constitute a criminal offense. The study concludes that it is important to establish the limits of the family relationship of the perpetrator in the crime of child abduction to ensure evidence during the preliminary investigation phase in the La Libertad Prosecutorial District between 2018 and 2020. Therefore, it is proposed to amend Article 147 of the Criminal Code to limit the family relationship to the second degree of kinship by blood or kinship.
