The purpose of this legal scientific study was to first identify the most important national and international protection mechanisms that ensure the adequate protection of homeless people in Peru. The meaning and scope of the state's special duty of protection are defined according to international standards on ""homeless people,"" so that the observed conditions can later be compared with the provisions or regulations on fundamental and constitutional rights that are in our 1993 constitution. In Peru, there is a lack of solutions for homeless people, and there has been no minimum initiative from the authorities before, during, and after the pandemic. There is also an absence of a multisectoral census to see if the number of homeless people has increased or decreased. Additionally, the rulings of the Inter-American Court of Human Rights were addressed, as well as international jurisprudence that already has laws on this subject, ensuring and upholding the rights of homeless people to eradicate the partial and total violation of their rights as citizens. In comparative law, the result was that each country has implemented laws in their legal systems to help eradicate this growing phenomenon of homelessness. Each country has its own methodologies on how these laws are implemented and which state organs are competent. It is also noted that regional and local authorities will be part of this effort. Therefore, based on all the information gathered throughout the investigation, it was finally analyzed whether these rights were violated and whether the State adequately protected homeless people and ensured their minimum survival
