Abstract: La presente tesis cualitativa dogmática, investigó a la Disposición de Ampliación de
Formalización de la Investigación Preparatoria. Su objetivo general fue Determinar el
fundamento legal, doctrinal y lógico (formal y jurídico) de la ampliación de la F.I.P. Sus
objetivos específicos fueron: Describir los supuestos de ampliación de F.I.P. en el proceso
penal peruano, describir las consecuencias de ampliar la F.I.P en el proceso penal peruano,
determinar si la ampliación de la F.I.P en el proceso penal peruano, vulnera derechos del
imputado. Se concluyó que:
La ampliación de la FIP carece de fundamento legal, pues no está regulada en la ley. No
puede ser integrada, ni interpretada analógicamente, ni bajo argumentos a fortiori.
La ampliación de la FIP carece de fundamento doctrinal, pues viola la teoría de la
inmutabilidad del objeto procesal.
La ampliación de la FIP carece de fundamento lógico, pues viola el principio lógico de no
contradicción, es desmontada a través de silogismo jurídico. Se sustenta su carencia de
fundamento a través de la ponderación de Alexy (Principio de legalidad Vs Economía
procesal) y bajo el esquema de Toullmin.
Se amplían hechos, imputados y delitos. Se clasifican en mutaciones unitarias, mutaciones
mixtas y mutaciones totales.
Se afecta el derecho de todo imputado a conocer los cargos por los que será investigado. En
el caso de nuevos imputados, se le afecta el derecho al plazo legal de investigación. Existe
indeterminación respecto al número de veces que se puede ampliar la F.I.P. y finalmente que
esta Disposición vulnera el derecho de todo imputado a conocer los cargos por los que será
investigado.

This qualitative dogmatic thesis investigated the Provision for the Extension of Formalization of the Preparatory Investigation. Its general objective was to determine the legal, doctrinal and logical (formal and juridical) basis of the extension of the FIP. Its specific objectives were: To describe the assumptions of extension of the FIP in the Peruvian criminal process, to describe the consequences of extending the FIP in the Peruvian criminal process, to determine whether the extension of the FIP in the Peruvian criminal process violates the rights of the accused. It was concluded that: The extension of the FIP lacks legal basis, since it is not regulated by law. It cannot be integrated, nor interpreted analogically, nor under a fortiori arguments. The extension of the FIP lacks doctrinal basis, since it violates the theory of the immutability of the procedural object. The extension of the FIP lacks logical foundation, since it violates the logical principle of non-contradiction, and is dismantled through legal syllogism. Its lack of foundation is supported through Alexy's weighing (Principle of legality vs. procedural economy) and under the Toullmin scheme. Facts, defendants and crimes are expanded. They are classified into unitary mutations, mixed mutations and total mutations. The right of every defendant to know the charges for which he will be investigated is affected. In the case of new defendants, the right to the legal investigation period is affected. There is uncertainty regarding the number of times that the FIP can be extended and finally that this Provision violates the right of every defendant to know the charges for which he will be investigated. 11 A legal modification was recommended to allow the extension of the Provision of Formalization of Preparatory Investigation
