Abstract: El numeral 3 del artículo 139° de la Constitución Política del Perú
contempla al debido proceso como principio, garantía y derecho de la
función jurisdiccional, que abarca la observancia al debido proceso y el
respeto de la tutela jurisdiccional efectiva.
Por otro lado, el numeral 2 del artículo 485° del Código Procesal Penal
respecto al proceso especial por faltas, establece que, si el imputado no
concurre en forma voluntaria a la audiencia, se le hará comparecer de ser el
caso necesario ordenar la prisión preventiva del mismo para y hasta que se
realice la audiencia.
Sin embargo, la figura de la prisión preventiva se encuentra regulada en
el artículo 268° del Código Procesal Penal para el caso de delitos, debiendo
configurarse los siguientes supuestos: a) Presencia de fundados y graves
elementos de convicción; b) La pena privativa de libertad a imponerse sea
mayor a cuatro (4) años; y c) El peligro de fuga o de obstaculización.
Siendo esto así, advertimos que el numeral 2 del art 485° del Código
Procesal Penal viene regulando la figura de la prisión preventiva para un
injusto menor como son las faltas; por lo tanto, resulta irrazonable su
aplicación, atendiendo, además, que para su procedencia deben concurrir
los presupuestos materiales que exige el art. 268° del citado texto legal

This being so, we note that numeral 2 of article 485 of the Criminal Procedure Code has been regulating the figure of preventive detention for an unjust minor such as misdemeanors; therefore, its application is unreasonable, taking into account, in addition, that for its origin the material budgets required by art. 268° of the aforementioned legal text
