Abstract: Uno de los fines que pretende un estado de derecho, es legitimar la
sanción penal, dicho fin pretendido solo será posible, si y solo si, se vulnera una
norma de conducta, respecto de la persona que tiene capacidad para quebrantar.
La vulneración antes mencionada tiene como causa la comisión de un delito o
falta, independientemente que la diferencia es cuantitativa y no cualitativa,
importa una sanción penal.
En nuestra legislación, tenemos; pena privativa de libertad, restrictivas de
la libertad, limitativas de derecho y multas, siendo de poco conocimiento la pena
de vigilancia electrónica personal, asimismo, la pena privativa de la libertad, es
la de mayor pesadumbre, puesto que, afecta de manera directa la libertad
ambulatoria del ciudadano.
Cada ilícito penal contenido en el decreto legislativo N°635, contiene
márgenes punitivos, entre un mínimo y un máximo, para romper el extremo
mínimo de la pena y sustentar una sanción, es necesario recurrir a las
denominada causas de disminución de punibilidad, para tal efecto en el año
2013, en el Perú se publicó la ley N° 30076, esta ley entre otras reformas,
incorporó el artículo 45- A para el cálculo cuantitativo de la pena.
Considerando lo antes mencionado, el juez al momento de determinar la
pena concreta final, debe seguir el procedimiento establecido en la disposición
del Código Penal, a fin de dotar de mayor predictibilidad la sanción penal que se
va a imponer y evitarse que ante casos similares se determinen penas distintas
en su aspecto cuántico. Por tanto, la ley no señala de forma expresa hasta que
limite se debe disminuir la pena, pues si bien es cierto la pena se determina por
debajo del mínimo, ese mínimo se convierte en un “nuevo máximo”, pero no se
expresa en la ley cuál sería el “nuevo mínimo”, finalmente es necesario una
regulación expresa en aras de existir una predictibilidad de la pena a imponerse
cuando concurran causas de disminución de punibilidad.
