The present research work, which has been titled: “The implementation of personal electronic surveillance as an alternative measure to preventive detention in the face of overcrowding in the El Milagro Trujillo Penitentiary Center – 2023”, has begun with the question: How does the implementation of personal electronic surveillance, as an alternative measure to preventive detention, allows overcrowding in the El Milagro 2023 Penitentiary Center? In such a way that the following general objective has been formulated: Analyze how the implementation of personal electronic surveillance as an alternative measure to preventive detention allows prison overcrowding in the El Milagro 2023 Penitentiary Center. Through the doctrinal and regulatory analysis of files referring to preventive detention from the Superior Court of Justice of La Libertad and interviews with judges, prosecutors and lawyers, it was determined that the excessive use of preventive detention is contributing significantly to overcrowding, and that the implementation of personal electronic surveillance could serve as an alternative measure to alleviate saturation. Finally, the following general conclusion has been drawn: Personal electronic surveillance, as an alternative to preventive detention, reduces prison overcrowding at the El Milagro Penitentiary Center by supervising the accused without imprisoning them, optimizing resources and respecting personal freedom. This promotes a more humane and efficient administration of justice without compromising public safety
