The present study entitled, “The procedure for appointing the judges of the Constitutional Court, balance and balance with the powers of the State in the Peruvian legal system”, its objective was to establish the balance and equilibrium that exists in the process of electing the judges. of the TC before the other state powers, was prepared through a basic study of a propositional comparative level, using as an instrument the compilation of data the documentary analysis instrument of the Magna Cartas of nations such as Ecuador, Colombia, Chile, Bolivia, Argentina and the United States. , as well as the comparative analysis of the constitution of 1997 and 1993; Obtaining results that, when compared with the Magna Carta of 1979 and 1993 on the subject of the election process of the members of the TC, have shown that the mechanisms had modifications, since before there were 09 members and in the other 07, and in its election, first the 03 state powers intervened and in the second case only the Congress; In comparison, in comparative law the process is under the command of 02 powers of the State. Where it is highlighted that there is a TC made up of professionals in legal matters, but that its rulings have questions from the residents due to their political relationships with its members
