Our thesis is titled: The pecuniary penalty derived from article 147-a of the consumer protection code due to the supplier's insistence at the hearing, and its negative impact on conciliation as a voluntary mechanism; and, in it we pose the following question: In what way does article 147-A of the Consumer Protection Code, which establishes the imposition of a fine on the supplier due to his failure to attend the hearing, distort the conciliation? In our research we set the following general objective: ""Demonstrate that article 147-A of the Consumer Protection Code, which establishes the imposition of a fine for the supplier's non-attendance, does have a negative impact on conciliation in consumer protection procedures."" ; and also the following specific objectives: Make known the scope and legal nature of conciliation as an alternative conflict resolution mechanism in Consumer Protection Procedures; analyze whether the imposition of a fine due to the supplier's non-attendance at the hearing negatively affects the voluntary agreement between the supplier and consumer; study the comparative regulatory analysis of the imposition of the fine on the supplier due to his failure to attend the conciliation hearing in the Consumer Protection Codes in Latin American countries; and, propose that the coercive fine measure be rescinded in the conciliation hearings in the Consumer Protection Procedures. Finally we arrive at the following main conclusion: “The financial penalty imposed on the supplier for non-attendance at the conciliation hearing, prescribed in article 147-A of the Consumer Protection Code, negatively affects conciliation as a voluntary mechanism; Therefore, the mere fact of regulating the imposition of a sanction for the provider's assistance would be generating interference of the will of the parties; since, the provider would proceed to provide assistance to avoid the imposition of a fine, but not because of the desire to conciliate
