The present investigation, which has been called legal bases so that the ascendant who has been forced to spend alimony does not have the right to receive it from his descendant, is based on the following question: What are the legal bases so that the ascendant who has been forced to pass alimony by court order do not have the right to receive alimony from your son or daughter? In the same way, the general objective was proposed: Demonstrate that the ascendant who has been forced to pay maintenance by court order is not entitled to receive alimony from his or her son or daughter. In this sense and keeping logical coherence with our proposed general objective, it was generally concluded that: It has been demonstrated that civil law is also equipped with a sanctioning system in specific situations towards legal subjects; In this sense, the ascendant who has been forced to pay alimony by court order should not be entitled to receive alimony from his descendant, because this would break the principle of equity and justice that the law advocates as a complex but coherent system. and unitary; and, this has been demonstrated by giving a brief review of articles such as 398, 412, 667 paragraph 7, 745 paragraph 1; and, 463 paragraph 3, all of these of the Civil Code
