The present study was conducted with the aim of determining whether the principle of the best interests of the child is violated in the regulation of Article 397 of the Civil Code concerning the consent required for an extramarital child to live in the marital home. This issue is rooted in the principles of protection against discrimination, the right to live in a family, and the evolution of the law over time, verifying compliance with international standards to safeguard the protection of the rights of extramarital children. The thesis employs a qualitative approach, with a causal-descriptive research design and type. The techniques utilized include documentary collection and observation. The study concludes that the best interests of the child are violated in Article 397 of the Civil Code, as the requirement for the spouse's consent for the extramarital child to reside in the marital home restricts the child’s fundamental right to live in a family and to coexist with their parent. This contravenes the principle that every child should grow up in a family environment conducive to their integral development. Furthermore, this provision introduces an unjustified distinction between extramarital and marital children, perpetuating discrimination that violates the principle of equality recognized in the Constitution and the Convention on the Rights of the Child. The exclusion of the extramarital child from the marital home may also generate feelings of rejection, abandonment, and lack of belonging, negatively impacting their emotional development and psychological stability.
