This Professional Sufficiency Work aims to analyze Decision 387/2022 of the Constitutional Court of Peru, which arises from a significant legal context involving violations of fundamental rights. This ruling addresses the constitutional amparo petition filed against the Asociacion Country Club El Bosque, where the petitioner claims violations of due process, defense rights, and associative freedom. The first chapter, explores the background and circumstances leading up to the Constitutional Court's Decision 387/2022. It will also cover the majority and dissenting opinions presented by Magistrate Domínguez Haro. The second chapter, develops the theoretical framework related to the legal nature of the right to association, the statutes, fundamental rights, and the proportionality test. Finally, the third chapter focuses on the legal analysis of Decision 387/2022, detailing the legal grounds that supported the magistrates decision. This analysis reviews the arguments presented by the parties, the voting rationale of the Constitutional Court, and the critical perspective of the authors of this professional sufficiency work. Based on this analysis, the authors recommend a review and modification of the Asociacion Country Club El Bosque’s statutes to enhance coherence and predictability in the protection of the fundamental right to due process.
